Common questions
How much sick leave does an employee accrue?
Most state laws use 1 hour of paid sick leave for every 30 hours worked (California, New York, Colorado, New Jersey, Massachusetts and others). Washington and Illinois use 1 per 40; Nevada 1 per 52. Annual use caps are usually 40 hours, with 48 in Colorado and Minnesota, 64 in New Mexico and 72 in Michigan for larger employers.
Do small employers have to pay for sick leave?
It depends on the state. Massachusetts, Oregon, Maryland and New York make leave unpaid or limit it below a size threshold, and Nevada exempts employers with fewer than 50 employees. Pick your state and headcount for your case.
Is sick leave paid out when someone quits?
Generally not under the statutes modelled here, but a combined PTO bank is vested wages in California and is paid out on separation. Check your state and your written policy.
